Domain Registration, Renewal, Transfer, Expiration, Recovery, and DNS Responsibility Policy
1. Purpose and Scope
This Domain Registration, Renewal, Transfer, Expiration, Recovery, and DNS Responsibility Policy explains the terms that apply when Spark Rack registers, renews, transfers, manages, or supports domain names for a Customer.
- All Spark Rack Customers and prospective Customers;
- All End Users, authorized users, administrators, and account contacts;
- All Spark Rack websites, portals, control panels, networks, servers, storage systems, software, and Services;
- All resellers and downstream customers where applicable;
- All Customer Data and Customer Content processed through the Services; and
- All third-party providers used to support an applicable Service.
Domain Services depend on registries, registrars, ICANN policies, country-code authorities, verification providers, payment processors, and other third parties. Those rules form part of the applicable Domain Service.
2. Nature of a Domain Registration
A domain registration is a time-limited contractual right to use a domain name subject to registry, registrar, ICANN, governmental, and other applicable rules.
A Customer does not purchase permanent ownership of a domain name. Registration rights may expire, be suspended, transferred, cancelled, deleted, disputed, or restricted under applicable rules.
3. Spark Rack’s Role
Spark Rack may act as a reseller, service intermediary, account manager, or technical provider for a registrar or registry.
The sponsoring registrar and registry retain authority over registration lifecycle, verification, transfer, renewal, suspension, redemption, and deletion.
Spark Rack cannot override a registry, registrar, court, governmental authority, or applicable consensus policy.
4. Customer Eligibility and Authority
Customer represents that Customer has legal authority to register and control each requested domain and to accept applicable registry and registrar terms.
Customer must satisfy eligibility, residency, nexus, organizational, trademark, professional, or other requirements imposed by a top-level domain.
Spark Rack may request supporting documentation and may cancel or decline a registration when eligibility cannot be verified.
5. Accurate Registration Data
Customer must provide and maintain accurate, current, complete, and nonmisleading registrant, administrative, technical, and billing information.
- Legal name or organization name;
- Physical or mailing address;
- Telephone number;
- Email address;
- Organization information;
- Eligibility information;
- Tax or business information where required; and
- Any other registry- or registrar-required data.
False, outdated, incomplete, or unverifiable registration data may result in suspension, transfer restriction, cancellation, or deletion.
6. Registrant Verification
A registrar or registry may require the registrant to verify an email address, identity, address, organization, or eligibility information.
Customer must complete verification within the required period. Failure may cause domain suspension, DNS interruption, transfer restriction, or cancellation.
Spark Rack is not responsible when Customer ignores, filters, blocks, or fails to receive a verification notice.
7. Registration Requests and Availability
A search result, cart placement, invoice, payment authorization, or Order acknowledgment does not guarantee that a domain has been successfully registered.
A domain remains available to others until the registry confirms registration. Between search and completion, another party may register the name, the registry may reject it, or the price may change.
If registration fails, Spark Rack may refund or credit the amount actually paid for the failed registration, excluding unrelated charges.
8. Premium and Variable-Priced Domains
A registry or registrar may classify a domain as premium or apply nonstandard registration, renewal, transfer, or restoration pricing.
Premium status and pricing may change. Customer is responsible for reviewing the price shown before each transaction.
A domain that had standard registration pricing may have different renewal or restoration pricing if permitted by the applicable provider.
9. Registration Term
A domain is registered for the term confirmed by the registry, subject to applicable maximum and minimum periods.
The expiration date shown in the Customer Portal is informational and may differ from a registry timestamp because of time zones, processing, transfer, auto-renew grace treatment, or provider synchronization.
Customer should renew well before the displayed expiration date.
10. Automatic Renewal
When automatic renewal is enabled, Spark Rack will ordinarily attempt to invoice and process renewal before expiration.
Automatic renewal is a convenience and does not guarantee successful renewal.
Renewal may fail because of nonpayment, expired payment credentials, provider outage, registry restriction, verification failure, legal action, transfer state, account suspension, pricing change, or another condition.
11. Manual Renewal
Customer may renew through the Customer Portal when renewal is available.
A renewal request is not complete until payment is received, the transaction is accepted by the sponsoring provider, and the registry confirms the new term.
Customer should verify the updated expiration date after renewal.
12. Renewal Notices
Spark Rack or the sponsoring provider may send renewal and expiration notices using the registrant or Account contact information.
Customer must not rely exclusively on reminders. The Customer is responsible for tracking expiration and maintaining functioning contact information.
Failure or delay of a reminder does not create a right to renewal, restoration, ownership, refund, or damages.
13. Expiration
A domain that is not renewed may expire and may stop resolving, stop receiving email, display an expiration page, be restricted, enter a grace period, enter redemption, or be deleted.
Websites, email, certificates, APIs, authentication, and other systems may fail when a domain expires.
Expiration does not guarantee that the domain can be recovered.
14. Post-Expiration Grace Periods
Some domains may be renewable after expiration during a registrar or registry grace period. The availability, length, price, and conditions of any grace period vary by top-level domain and provider.
Spark Rack does not guarantee any specific post-expiration grace period unless required by applicable policy.
A registrar may interrupt DNS resolution, change nameservers, place the domain on hold, or delete the registration during the post-expiration lifecycle.
15. Redemption and Restoration
After deletion from the registrar account, some domains may enter a registry redemption period during which restoration may be possible for an additional fee.
Redemption is not available for every top-level domain and is not guaranteed.
Customer must pay all applicable renewal, restoration, registry, registrar, and administrative charges before Spark Rack attempts restoration.
Payment does not guarantee successful restoration.
16. Pending Delete and Release
After applicable grace and redemption periods, a domain may enter a pending-delete or equivalent state and may no longer be recoverable.
When the registry releases the domain, any person may attempt to register it. Spark Rack cannot reserve, reacquire, or guarantee recovery of a released domain.
17. Transfers to Spark Rack
A transfer into Spark Rack requires a valid domain, eligible transfer status, correct authorization code where required, access to approval communications, and compliance with registrar and registry rules.
A transfer may fail or be delayed because of:
- Transfer lock;
- Recent registration or prior transfer;
- Recent registrant-information change;
- Incorrect authorization code;
- Expired or invalid approval email;
- Registrant objection;
- Nonpayment;
- Dispute or court order;
- Registry restriction;
- Unsupported top-level domain;
- Provider outage; or
- Another policy-based restriction.
18. Transfers Away From Spark Rack
Customer may request transfer of an eligible domain away from Spark Rack subject to identity, Account, billing, security, registrar, and registry requirements.
Spark Rack may require the domain to be unlocked, the Account to be verified, contact information to be current, and all valid charges for prior registration periods to be paid.
A transfer away does not automatically cancel hosting, email, DNS, SSL, backup, or other Services.
19. Transfer Locks and Registrant Changes
A domain may be subject to mandatory or optional transfer locks after registration, transfer, registrant change, suspected compromise, dispute, or security event.
Customer must review the consequences before changing registrant information. A change may trigger a transfer restriction or require additional verification.
20. Authorization Codes
An authorization code is sensitive credential information. Customer must protect it from unauthorized disclosure.
Spark Rack may require identity and authority verification before releasing a code.
Customer is responsible for transfers initiated with a code disclosed by Customer or an authorized Account user, except where applicable law requires otherwise.
21. Domain Ownership and Account Disputes
Spark Rack is not a court and ordinarily will not decide private ownership, employment, partnership, shareholder, family, contractor, web-developer, or agency disputes.
Spark Rack may lock the domain, preserve records, restrict changes, require agreement of the parties, or require a court order or recognized dispute decision.
The person who pays an invoice is not automatically the legal registrant, and the person listed as a technical contact is not automatically the owner.
22. UDRP, URS, Court Orders, and Legal Process
Domains may be subject to the Uniform Domain Name Dispute Resolution Policy, Uniform Rapid Suspension System, registry procedures, court orders, governmental action, and other dispute mechanisms.
Spark Rack may lock, transfer, suspend, cancel, preserve, or disclose information as required by applicable process.
Customer is responsible for responding to disputes and obtaining legal advice.
23. Abuse and Policy Enforcement
Spark Rack, the registrar, or the registry may suspend, place on hold, redirect, lock, transfer, or cancel a domain used for phishing, malware, spam, fraud, child exploitation, intellectual-property infringement, unlawful activity, or another policy violation.
Domain action may occur without advance notice when necessary to prevent harm or comply with law.
24. WHOIS and Registration Data Services
Public registration-data availability depends on registry, registrar, privacy, proxy, and legal requirements.
Spark Rack does not guarantee that registrant data will be public, private, redacted, searchable, or available through a particular protocol.
Privacy or proxy service does not make a registrant anonymous to Spark Rack, the registrar, the registry, or lawful authorities.
25. Privacy and Proxy Services
When available, a privacy or proxy service may display substitute contact information in public registration data.
The service may be suspended or disclosures may occur when required by law, provider terms, dispute process, abuse investigation, payment issue, or verification requirement.
Customer must still provide accurate underlying information.
26. Nameservers and DNS
Customer is responsible for configuring correct nameservers and DNS records unless a managed DNS Service expressly assigns that task to Spark Rack.
Changing nameservers or DNS records can interrupt websites, email, certificates, authentication, and other systems.
DNS propagation and caching vary across resolvers and are not controlled by Spark Rack.
27. DNSSEC
DNSSEC can improve authenticity but can also make a domain unreachable when keys, delegation signer records, signatures, algorithms, or provider transitions are misconfigured.
Customer must coordinate DNSSEC changes during transfers, nameserver changes, and provider migrations.
Spark Rack may disable or require correction of DNSSEC when needed to restore resolution or complete a transfer.
28. Domain Contact Security
Customer must secure the email account, telephone number, Account credentials, multifactor authentication, and recovery information associated with a domain.
Compromise of a registrant email or Account may permit unauthorized transfer, DNS change, renewal change, or control loss.
Customer must report suspected compromise immediately.
29. Minor Users and Domains
A Customer under eighteen must satisfy the Spark Rack Children’s Privacy, Minor Account, and Parental Authorization Policy.
Spark Rack may require a verified Parent or Legal Guardian to be the Account owner, billing contact, or registrant.
30. Billing and Refunds
Domain fees are generally nonrefundable once submitted to the registrar or registry.
This includes registration, renewal, transfer, redemption, restoration, premium, registry, privacy, and other domain-specific charges.
A failed transaction may be refunded or credited only to the extent Spark Rack did not incur the applicable provider charge.
31. Customer Responsibility Before Cancellation
Before cancelling or closing an Account, Customer must transfer or otherwise secure every domain Customer intends to retain.
Account cancellation does not guarantee continued domain access. Domains may expire, become locked, or be deleted if not properly transferred or renewed.
32. No Guarantee of Continuity
Spark Rack does not guarantee perpetual domain availability, renewal, restoration, registry operation, registrar operation, transfer completion, DNS propagation, or freedom from dispute.
Customer should maintain alternate communication methods and continuity plans for critical domains.
33. Contact
Domain questions and transfer requests should be submitted through the domain-management or support channel in the Customer Portal.
