Virtual Private Server and Dedicated Server Supplemental Terms
1. Purpose and Scope
These Virtual Private Server and Dedicated Server Supplemental Terms apply to virtual machines, bare-metal servers, colocated or leased hardware where offered, IP addresses, storage, network access, and related server Services.
2. Management Boundary
Unless a managed plan expressly states otherwise, server Services are unmanaged.
Customer is responsible for operating systems, applications, accounts, firewall, security, patching, backups, monitoring, licensing, and administration above the infrastructure layer.
3. Administrative Access
Customer may receive root, administrator, console, or equivalent access and accepts responsibility for all actions performed with that access.
Spark Rack may retain emergency or platform access where necessary to operate the Service.
4. Supported Operating Systems
Spark Rack may provide templates or installation media but does not guarantee support for every operating system or version.
End-of-life, custom, modified, or unlicensed systems may receive limited or no support.
5. Resource Allocation
Allocated CPU, memory, storage, bandwidth, port speed, IP addresses, and other resources are described in the Order.
Burst, shared, fair-use, or contended resources are not equivalent to dedicated guaranteed capacity unless expressly stated.
6. Network Use
Customer must maintain secure network configuration and must not spoof addresses, announce unauthorized routes, operate open relays or proxies, scan without authorization, or interfere with the Network.
Spark Rack may filter, null route, rate limit, or suspend traffic to protect infrastructure.
7. IP Addresses
IP addresses remain controlled by Spark Rack or the applicable provider and may be changed, reclaimed, renumbered, filtered, or withdrawn.
Customer acquires no property right in an IP address and must update DNS, licenses, and allowlists after a required change.
8. Hardware
Dedicated hardware may fail and may require replacement, repair, migration, or data restoration.
Equivalent replacement may differ in manufacturer, model, firmware, or component details while providing materially comparable capacity.
9. Storage and Data
Storage redundancy does not replace backups. Customer must maintain independent backups.
Spark Rack does not guarantee recovery after disk, array, filesystem, encryption, or Customer configuration failure.
10. Licensing
Customer is responsible for software-license compliance and all license fees not expressly included.
Spark Rack may disable unlicensed or prohibited software and may cooperate with valid vendor enforcement.
11. Security and Compromise
Customer must patch and secure the server and promptly respond to compromise.
Spark Rack may isolate, suspend, reinstall, or require remediation of a server creating material risk.
12. Monitoring
Infrastructure monitoring does not guarantee detection of guest operating-system, application, malware, data-integrity, or Customer configuration failures.
Customer must monitor the workloads Customer considers critical.
13. Reboots and Maintenance
Server Services may require reboot, shutdown, migration, or component replacement for security, maintenance, or repair.
Spark Rack will provide notice where practical but may act immediately in an emergency.
14. Remote Hands and Professional Services
Console work, custom installation, data recovery, hardware changes, cabling, complex troubleshooting, and after-hours nonemergency work may be billable.
15. Cancellation
Customer must export data and remove dependencies before cancellation.
Servers, disks, addresses, licenses, and backups may be released or erased after termination.
16. Acknowledgment
- Unmanaged servers are administered and secured by Customer.
- Administrative access carries full responsibility.
- Hardware, storage, and networks can fail.
- IP addresses are licensed resources and may change.
- Customer must maintain independent backups and monitoring.
- Spark Rack may isolate or suspend risky systems.
